SDNY COURTHOUSE,
May 25 – Juan
Diaz was
arrested on
November 9,
2022 for
dealing
fentanyl in
The Bronx.
The
complaint
referenced a
bag with 400
packets of
fentanyl and
22 rounds of
nine
millimeter
ammunition.
Diaz was
released on
$50,000 bond
and his case
was repeatedly
"continued in
the interest
of
justice."
On
May 25, 2023,
Inner City
Press met Diaz
outside the
Magistrates
Courtroom of
the U.S.
District Court
for the
Southern
District of
New York, from
which Inner
City Press had
been asked to
step out for a
sealed
proceeding.
Inner City
Press told
Diaz about the
exclusion, and
that it was
there to
report on
proceedings.
Diaz had
arrived early,
to plead
guilty. The US
Attorney's
Office had
given him a
so-called
Pimintel
letter,
estimating his
guideline
sentence at 57
to 71
months.
Inside
the Mag Court,
after the
sealed
proceeding was
over,
Magistrate
Judge Gabriel
W. Gorenstein
asked Diaz if
he was seeing
a doctor.
Diaz
said yes, as
he had out in
the hall, he
has plate with
screws in his
back. But he
is not taking
medication
that would
impact his
ability to
plead
guilty.
Plead
he did. The
case was
wheeled out to
District Judge
Lewis A.
Kaplan and
sentencing set
for August 23,
2023.
The
case is now US
v. Diaz,
23-cr-260
(Kaplan /
Gorenstein)
