Man from Venezuela Charged With Armed Car Jacking in Manhattan Is Detained for Trial

SDNY COURTHOUSE, May 24 –      In the Magistrates Court of the SDNY on May 24 a bail or jail hearing was held on defendant Alexis Mercedes, charged with an armed car-jacking on Sixth Avenue in Manhattan while on parole in a New Jersey case. 

 Presiding was U.S. District Court for the Southern District of New York Magistrate Judge Gabriel W. Gorenstein. Inner City Press there, thread here:

 OK - now at bail hearing for man charged with armed car jacking of a ride-share vehicle on 6th Ave in Manhattan - from which he drove to a nightclub in The Bronx. He has a retained (paid) lawyer

 Here in Mag court there's a break in the action - Judge asked if defendant's New Jersey parole said "no guns." Neither side knew: they're checking. Defendant has a face tattoo. Defense lawyer now emailing the judge. 

After 25 min break, AUSA returns to tell judge Bergen County probation says they cannot look at defendant's conditions of release. So law of Middlesex County is quoted.

Defense lawyer calls it a gray area, and says NJ gun laws are being struck down under Bruen. 

 Judge Gorenstein: I am ordering detention. If convicted, he would be deported [to Venezuela], he has an incentive to flee. 

 The case is US v. Mercedes, 23-mj-4230 (Gorenstein)
