As Felon with Ammo Said He Was Sprayed
Pled Guilty US Says Category IV

SDNY COURTHOUSE,
July 30 –
Marvin Minott a/k/a Tyson
Smith is charged with being a
felon in possession of
ammunition, to wit, one .38
caliber shell
casing.
On April 5, U.S. District
Court for the Southern
District of New York Judge
Andrew L. Carter held a
proceeding. Inner City Press
covered it.
After Judge
Carter asked about the status
of discovery and its review,
Minott spoke for himself and
said he has been "sprayed like
an animal" while in detention.
Jump cut
to December 20, 2023 - the
trial had been postponed, most
recently for a competency
exam. In the interim a jail
call was read out to Judge
Carter, a woman offered to say
it was her gun.
Dr. Ryan Nybo met
with Minott for two hours;
"the defendant did not agree
to further evaluation." On
December 20, with the finding
of competency uncontested, a
February 12, 2024 trial date
was set. Minott was allowed to
speak with his sister in the
courtroom for two minutes - he
was the last detainee of the
day to be taken from the
courthouse.
On February 6,
2024, Minott pled guilty to
count 1 of the indictment.
On July 3, the US
Attorney's Office wrote in to
ask for 10 years.
On July 30, the
US Attorney's Office further
specified that, with a point
added due to the offense being
committed while under
post-release supervision, the
criminal history category is
IV. Sentencing is now set for
August 8 at 11 am.
