Jan 14 – A defendant
charged with shooting
gun on Southern Boulevard in
broad day light was up for a
bond hearing on January 13
before U.S. District Court for
the Southern District of New
York Magistrate Judge Gary
Stein. Inner City Press was
there, the only media in the
SDNY Mag court, thread:
AUSA: The day
before he was Federally
arrested there was a report he
had another gun that went off:
he threw a person into
oncoming traffic.
Judge: Any
New York State convictions or
charges pending? AUSA: No.
[Amid this argument, another
shackled defendant is led
through, in MDC tan and blue
laceless shoes, attempts to
sit down in chair, is told No]
Defense: I don't
know much about this Bail
hearing is pushed into future
so prosecutors can redact
documents
Update: A
fire alarm, now cleared, in
SDNY postponed the re-start
this bail hearing...
Update II: Bail
hearing belatedly resumes.
Defense: These reports are
hearsay. The pre-trial
services report does not have
anything about arrests. Judge:
I release you on unsecured
bond once co-signers.
At the
end, the AUSA said her office
may appeal, presumably to the
Part 1 judge.
On January 14
District Judge Analisa Torres
issued a stay: "The January
13, 2025 bail order, ECF No.
5, is STAYED and Defendant
shall remain detained pending
the Court's decision on the
Government's appeal of the
order. By January 15, 2025,
Defendant shall file his
response (Signed by Judge
Analisa Torres on 1/14/2025)
