Conspiracy Trial Had Cooperator now US
Withholds Personalty so May 16 hearing

SDNY COURTHOUSE,
May 4 – Wilkin De Los Santos
in charged in a conspiracy to
false obtain iPhones for
resale.
On June 22,
2022 U.S. District Court for
the Southern District of New
York Judge Analisa Torres
presided over his trial. Inner
City Press went and covered
it.
The
witness was describing dozens
of cell phones mailed from
states ranging from Wyoming to
Colorado. On the screen a
spreadsheet of the phone
transfers.
There was
been extensive pre-trial
motion practice about the
admission of business records.
On June 23, on
the stand being cross examined
was a cooperator who admitted,
after signing his plea deal,
to continuing to sell
Play-Dough to look like new
iPhones. He got a new
cooperation deal on June 20
and was asked about it. There
are crimes it does not cover.
On June 24, the
defendant was found guilty and
ordered to home confinement
pending sentencing: "ORDER as
to Wilkin De Los Santos: On
June 24, 2022, Defendant was
found guilty by a jury of
Counts One, Two, and Three of
the Indictment. Defendants
bail is continued but is
modified to include a
condition of home detention
with location monitoring. SO
ORDERED. (Signed by Judge

On July 22, Judge
Torres followed up: "ORDER as
to (19-Cr-391-) Gerald Vasquez
(1), Gary Bierd (2), Irvin
Castillo (3), Daubriel Disla
(4), Jose Vargas (6). At the
sentencings for Defendants
Vasquez, Bierd, Castillo,
Disla, and Vargas, the
Government represented that it
would be providing the Court
with additional information
related to restitution by
specific dates that have since
passed. The Court has not
received any further
information related to
restitution. Accordingly, by
August 5, 2022, the Government
shall provide the restitution
information for Defendants. SO
ORDERED. (Signed by Judge

On May 3, 2023,
counsel for Gerald Vasquez in
the case wrote to Judge Torres
asking for a conference
because, he said, despite the
Court's order that the
Government return his
personalty taken at the time
of arrest, despite many
requests to the named AUSAs,
it has not been done.
On May 4, Judge
Torres docketed: "MEMO
ENDORSEMENT as to Gerald
Vasquez granting [233] LETTER
MOTION addressed to Judge
Analisa Torres from Alan
Seidler dated 5-3-2023 re:
status conference sought.
ENDORSEMENT: GRANTED. A
telephonic conference is
scheduled in this matter for
May 16, 2023."
