ATP Discovery Stayed As Amended
Complaint Due June 24

May 27 – Some players on the
tennis tour sued the ATP -
then alleged that the ATP was
threatening those who sued,
and pressuring others to sign
a petition against the
lawsuit. The motion was
hearing on April 11 before
U.S. District Court for the
Southern District of New York
Judge Margaret M. Garnett.

if I stayed on the lawsuit I

Opelka: Yes.
Judge: I'll rule
later.
A week later, in
the run-up to ruling, ATP made
its post-hearing submission
including that "With respect
to Jay Clarke, Mr. Pospisil
testified that Mr. Clarke
withdrew because of pressure
from an unnamed sponsor, not

On April 23 the
ATP defendants wrote in
seeking to delay the May 8
initial pre-trial conference
until the second half of June
- and noted that the
plaintiffs / players oppose

On May 27 Judge
Garnett ordered that "the
Plaintiffs will file their
Amended Complaint by June 24,
2025. By July 1, 2025, the
parties shall submit a joint
status letter proposing next
steps in the case. That letter
shall address the parties'
views on a briefing schedule
for any new or renewed motions
to dismiss, as well as whether
any discovery should commence
and in what form and on what
schedule. The parties are
particularly encouraged to
consider and discuss a more
accelerated briefing schedule
for motions to compel
arbitration and/or transfer
venue, as well as whether some
amount of class certification
discovery can commence. Formal
discovery is stayed until
further order of the Court.
