Herrera was
arrested in
The Bronx
handed over
two kilos of
fentanyl to an
undercover.
On
August 18,
2023 he
appeared
before U.S.
District Court
for the
Southern
District of
New York
Magistrate
Judge
Katharine H.
Parker. Inner
City Press was
there, the
only media in
the SDNY Mag
Court.
The prosecutor
said that the
defendant had
been in an
apartment with
a drug press
and glassines
and must have
known.
The
defense
disagreed and
argued for
release. The
prosecutor
acknowledged
that the
location of
the fentanyl
transfer and
his residence
is five miles
on Google
Maps.
He was
released on
$20,000
unsecured
bond, with the
distance
between the
two locations
cited.
On
October 18,
the duo were
indicted and
the case
assigned to
District Judge
Victor
Marrero.
Jump
cut to January
7, 2025 when
the US
Attorney's
Office wrote
in seeking an
adjournment of
30 days saying
"the parties
are actively
discussing a
potential
pretrial
resolution...
This is the
last
adjournment
the parties
will seek."
On
February 4 the
US Attorney's
Office wrote
in about Cruz
Herrera,
asking to push
a February 7
conference
forward 90
days because
he is
scheduled to
plead guilty
in Magistrates
Court on
February 10 at
10 am.
