Man Bitten by NYPD Dog 2008 Mid Trial in 2023 Says Settlement and to Dismiss in 21 Days

SDNY COURTHOUSE, May 5 – Jermaine Dunham, after being bitten by an NYPD police dog in 2008, filed a handwritten, pro se lawsuit in 2011.

 On May 2, 2023 the trial was finally winding down before U.S. District Court for the Southern District of New York Judge Andrew L. Carter  Inner City Press was there, the only media in the courtroom. 

  Judge Carter wanted to have the closing arguments in the afternoon, fifty minutes each.

But the NYC Corporation Counsel could not or would not commit to 50 minutes, wanting to push it to May 3.

That will occur - and late on May 2, the City wrote in to "establish" that plaintiff "reached for the gun after Officer Lobello placed his hand on Mr. Dunham's chest." 

On May 3, Dunham's counsel wrote to Judge Carter to say "the Parties have agreed to a settlement-in-principle resolving... the terms of the agreement, but intend to file a suitable stipulation of dismissal within 21 days."

The case is Dunham v. Lobello, 11-cv-1223 (Carter)
