SDNY COURTHOUSE,
June 5 – Massachusetts based
but online FSP Books was sued
by Andrew Toro for having an
inaccessible website.
On June 5,
U.S. District Court for the
Southern District of New York
Judge Andrew L. Carter held a
status conference. Inner City
Press covered it.
Defense counsel wanted to file
a motion to dismiss for lack
of personal jurisdiction.
Judge Carter asked him if he
had any case law to support
it. Defense counsel replied
that it was possible his
client had not done any
business in New York in the
last year.
Judge Carter
asked for a joint status
letter by June 22, including
if applicable a schedule for
jurisdictional discovery.
He noted that
attorneys fees would soon
surpass the value of the case.
The case is Toro
v. FSP Books, Inc., 22-cv-7078
