Months on Man Who Took Gun to
Bronx Restaurant But Judge Gives
28 Months

COURTHOUSE,
Aug 8 – A man who pled guilty
to taking a gun into a Bronx
restaurant and getting into a
fight during which it went off
was up for sentencing before
U.S. District Court for the
Southern District of New York
Judge Andrew L. Carter on
August 8. Inner City Press was
there.
The Federal
Defender, at the prior remand
hearing on February 1, said
"Only Mr. Rosario suffers the
immediate consequences of his
own alleged gun
possession."
The
Assistant US Attorney on
August 8 was asking for a 37
month sentence, citing the
defendant's remand after he
accused his girlfriend of
cheating on him, and grabbed
and refused to return her
phone. The Federal Defender
called this domestic distress,
not domestic violence.
Judge
Carter said he had been
planning to impose a 30 month
sentence but now after hearing
from the parties dropped it to
28 months.
