NJ Man Arrested for Trying to Join Al Shabaab After Oct 7 via Egypt Now Gets CIPA Schedule

SDNY EXCLUSIVE, Aug 5 – A man who left New Jersey to try to join Al Shabaab, inspired or triggered by the October 7 Hamas terrorist attack on Israel and its aftermath, argued to be released on bail on December 29 in U.S. District Court for the Southern District of New York Magistrates Court.

Inner City Press was there, the only media in the SDNY Mag court, and live tweeted, thread:

KARREM NASR, a US citizen, was taken into custody in Nairobi, Kenya on Dec 14, 2023 and was transported to the US yesterday.   Nasr is led in by US Marshals.

Judge: You were unemployed when you went overseas? Nasr: I left my job. Judge: You have $1700 in savings and some community college? Nasr: Yes. AUSA: We seek detention. 

Judge: I would have to speak with the parents. FD: I want a decision today. 

 AUSA: Even with Internet restriction, he could see the Hamas Israel war in the newspapers, they are still a thing.

 Judge: These are terrorism charges... You chose jihad over studying. I order you detained. 

A preliminary hearing was set for January 12.

But the day before, on January 11, 2024, Nasr's case was indicted and assigned to District Judge Analisa Torres.

On January 17, Nasr was arraigned and pleaded not guilty - not before Judge Torres, but rather sitting Magistrate Judge Katharine H. Parker, with Speedy Trial Act time excluded until January 31...

On April 24, the US Attorney's Office opposed Nasr's bid for bail, now quoting him tweeting against "a post announcing the birth of a gay couple's son via surrogate" by stating, "and this is why we fly jets into skyscrapers."

On May 20, the US Attorney's Office wrote to Judge Torres nominated Classified Information Security Officer and alternates.

On June 7, in support of a pending application to get Nasr freed from detention, his lawyer wrote in citing a decision by EDNY District Judge Natasha C. Merle freeing Halima Salman who was in ISIS-held territory in Syria - she allegedly married an ISIS fighter, learned to use an AK-47 and lied to the FBI. But she was ordered released.

On August 1 the US Attorney's Office submitted a joint status letter, in which they say that "preliminary discussions about a pretrial resolution are ongoing." The defense says its retained expert is preparing a mitigation letter it expects to submit by the end of August. Publicly?

On August 5, Judge Torres set a schedule: "itsuko MEMO ENDORSEMENT as to Karrem Nasr on re: [33] LETTER by USA as to Karrem Nasr addressed to Judge Analisa Torres from Camille L. Fletcher dated 8/1/2024 re: Status Update on Discovery and Plea Discussions (Joint Submission). ENDORSEMENT: 1. The Government's motion to adjourn its CIPA Section 4 motion deadline is GRANTED. 2. Defendant's motion for a CIPA Section 2 conference is GRANTED. On September 23, 2024, at 1:00 p.m., the Court will hold an ex-parte, classified CIPA Section 2 conference with defense counsel. 3. By September 3, 2024, the parties shall file a joint letter addressing the status of discovery, discussions concerning a pretrial disposition of the matter, and any anticipated motion practice. (Signed by Judge Analisa Torres on 8/5/2024) Set/Reset Hearings as to Karrem Nasr: Status Conference set for 9/23/2024 at 01:00 PM before Judge Analisa Torres."
