Honduran Woman Applying for U Visa Moved by ICE to TX Now SDNY Judge Orders Return

SDNY COURTHOUSE, June 20 – A Honduran woman with a pending U-Visa application who was detained by ICE on June 4 has filed a habeas corpus petition in the U.S. District Court for the Southern District of New York courthouse on June 6, where Inner City Press found it.

  The complaint recounts how at a required check-in at the ICE contract who oversees her supervised release she was separated from her attorney. It says she fled to the US in 2025, to escape "her abusive husband in Honduras." In 2021 she complained to NYPD of an attempted rape and cooperated; she applied for a U-Visa.

  On June 2 she got an automated message to appear at the ISAP office on June 3 on June 4. She did, and was detained - and now does not appear in the ICE online detainee locator system.

Her name is Candida Ramirez Lopez.

On June 9, amid a hiccup about deficient pleading, her case was assigned to District Judge Jeannette A. Vargas.

Late on June 18 her counsel filed, in advance of an oral argument, a memo recounting days in holding cells in 26 Federal Plaza, sleeping on the floor, ferried to NJ and now in the Houston Contract Detention Facility.

On June 20, Judge Vargas ordered her returned to New York: "The Court hereby ORDERS: 1) Respondents shall transport Petitioner Candida Ramirez Lopez (A Number 098-982-272) back to the Southern District of New York by Monday, June 23, 2025, and immediately upon effectuating her transfer, shall release Petitioner from custody, subject to the same terms of supervised release that pertained to Petitioner prior to her detention by Immigration and Customs Enforcement ICE on June 4, 2025. 2) The Court has reserved decision on the aspect of Plaintiff's motion for a TRO and habeas petition that seeks a stay of removal. During the pendency of the Court's consideration of this issue, however, Petitioner shall not be removed from the United States unless and until the Court orders otherwise in order to preserve the Court's jurisdiction. A written opinion setting forth the basis for the Court's decision will follow. SO ORDERED. (Signed by Judge Jeannette A. Vargas on 6/20/2025)
