As Jury for Sarah Palin 2d Defamation Trial against NYT Picked in Morning 2d Circuit Fight

SDNY COURTHOUSE, April 14 – The Friday before the second round of Sarah Palin versus New York Times, a final pre-trial conference was held by U.S. District Court for the Southern District of New York Judge Jed S. Rakoff. Inner City Press, which covered the first trial, live tweeted it,from the thread:

Judge Rakoff: How long do you want for openings? Palin's lawyer: 45 minutes. NYT lawyer: 30 minutes. Judge Rakoff: You don't oppose the introduction in the trial of the whole editorial, do you? Palin's lawyer: We don't oppose.

NYT lawyer: They should have a copy   NYT lawyer: Having a copy they can construe possible interpretations. They should have it early. Judge Rakoff: I'll mull it over.

On April 14 before the jury was picked before noon, from thread:

Palin's lawyer: 2d Circuit found this to be defamation per se --

Judge Rakoff: In the context of special damages. Palin's lawyer: It's been adjudicated. But we dont' want to try this case a 3d time.

Judge: I have until tomorrow to resolve this - no openings today

[Note: Sarah Palin is here, at plaintiff's table with four lawyers. NYT seems to have 5 lawyers]

The case is Palin v. The New York Times Company, 1:17-cv-4853 (Rakoff)
