Saipov Guilty on All 28 Counts In 1st Stage Trial Now ADX Florence Talk Goes In Camera

SDNY COURTHOUSE, Feb 2 - Sayfullo Saipov after being found guilty on 28 counts now faces a penalty phase that may result in the death penalty for killing eight people with a van along the West Side Highway.

  On May 4, 2022 U.S. District Court for the Southern District of New York Judge Vernon S. Broderick held a conference on the case and Inner City Press live tweeted it here.

On January 26, Saipov was found guilty on all counts, after jury questions about whether he did it to join or advance himself in ISIS or not. That will be a major issues, along with any mitigation, in the penalty phase to come.

The US Attorney's Office said Saipov "was found guilty of eight counts of murder in aid of racketeering activity, which carry a penalty of death or life in prison... The penalty phase is scheduled to begin on February 6, 2023." [That seems to have slipped, to February 13].

On February 1, Judge Broderick docketed: "ORDER as to Sayfullo Habibullaevic Saipov. The Government Wall Team and Defense counsel shall meet tomorrow at 11:00 AM in Courtroom 24B. Following a finding in open-court, the conference will proceed in camera (Signed by Judge Vernon S. Broderick on 2/1/2023)."

  Inner City Press went. Judge Broderick read a script about the presumption in criminal cases of openness to the public and press - then said because this discussion implicated defense strategy about ADX Florence in Colorado, it would be sealed, in camera, in the jury room. Federal Defenders asked to bring in an additional person, which was allowed, with some sort of summary expected on February 4. Watch this site.
