Skydiving Teacher With Name Forged Sued US Parachute Association & Wants Discovery Stay

SDNY COURTHOUSE, Sept 14 – Yuri Garmashov was a skydiving instructor certified by the US Parachute Association when his signature was forged for a jump that resulted in death. He was de-certified by USPA, and he sued.              

     On January 31, U.S. District Court for the Southern District of New York Judge John G. Koeltl held a proceeding. Inner City Press covered it. 

 The case was first filed in California, then dismissed without prejudice to see if the parties could settle. They had not.

Then they did - almost. On June 1, 2022, Judge Koetlt held another conference, and Inner City Press again covered it.

Garmashov's lawyer said he had a binding settlement, $150,000 and an agreement about  membership; he said the talk had turned to a W-9 and wire instructions. The Association's lawyer disagreed.

Garmashov's lawyer countered that a criminal case against the name who allegedly used Garmashov's signature, if resulting in plea or conviction, could change things. Judge Koeltl said it would take him some time to rule on a motion, and marveled that this case would proceed to trial. In the end, it emerged there was no court reporter on the line.

Jump cut to September 14, 2022, when a joint letter was filed with Magistrate Judge Ona T. Wang, recounting a defense-only then plaintiff-only settlement call. The defense has serve a notice of deposition, while the plaintiff presumed discovery is stayed.

The case is Garmashov v. United States Parachute Association, Inc., 21-cv-4917 (Koeltl Wang)
