On Eve of 6ix9ine Sentencing Victim Impact Filing About Backpack and Rap-A-Lot

SDNY COURTHOUSE, Dec 17 – In the case of US against Aljermiah Mack and Anthony Ellison, the jury on October 3 returned a mixed verdict, see below. Daniel Hernandez / Tekashi 6ix9ine who testified for three days against them is now set to be sentenced on December 18 at 10 am, with the government's submission including under Section 5K1 due on December 11 or before.  Inner City Press tweeted the order here, and the underlying submission rules here.

 Now on the eve of #6ix9ine's sentencing a victim's impact letter has been filed, which we publish here in full, more on Patreon here;

"December 16, 2019 To: Wendy Olsen Clancy, Victim Witness Coordinator United States Attorney’s Office Southern District of New York Victim Impact Statement of Skyy L. Daniels Dear Your Honor, I am contacting you today to discuss the impact of a traumatizing situation, I, long time international Publicist, , professionally known as Skyy L. Daniels, and my assistant publicist, survived after being attacked, robbed, and possibly almost kidnapped by high-profile rapper, Daniel Hernandez, aka Tekashi 6ix9ine and his associates. Tekashi 6ix9ine and his Nine Trey Gangster Bloods were convicted for committing several brazen acts of violence around New York City including a robbery that took place on April 3, 2018. I was targeted by Tekashi69 but the whole thing was a sad case of mistaken identity.

In a nutshell, their intended target was a record label out of Houston, Texas, Rap-a-Lot Records and some of their representatives, who I later learned that there was some kind of industry/street beef between Tekashi 6ix9ine/Treyway and J. Prince Jr./Rap-a-Lot.

When the robbery occurred, they came in yelling in the building lobby, get on the ground, F*ck Rap-a-Lot. I feel I was a target perhaps because I am from Texas and Rap-a-Lot has contributed to my community charitable events in the past and the label, like many other labels, are listed on my curriculum vitae. However, my assistant, had no such affiliations at any capacity.

As a career entertainment publicist for nearly two decades, I have been connected to a great deal of famous record labels, artists, athletes, public and political figures. During the robbery, my backpack was stolen. It was filled with expensive high-end personal items and several important business confidential hard drives that I have yet to see again. My backpack was later recovered in Tekashi 6ix9ine’s home along with the cell phone he filmed the actual incident with himself. This is documented and sworn information per Federal Agents, FBI investigation reports, and all of the court transcripts and testimonies. As a result of this entire ordeal, I have suffered greatly from mental anguish and emotional distress.

So traumatized by this aftermath, that over a year later, I have had a difficult time getting past the incident suffering from what we believe is post-traumatic stress disorder. To add insult to injury, he released the video of me escaping from the clutches of his thugs on social media and it went viral accumulating millions of views as the public laughed. I am a mother and grandmother first and it is so hard to describe what it feels like to survive that occurrence. Ever since, I find myself unable to do the simple things an adult should do. It’s easy for me to block out my feelings and avoid things that make me uncomfortable.

I have emotional, mental and  financial problems as this uncomfortable situation has left me displaced without work. I went as far as to leave Texas, hiding in the home of a close friend to avoid the watchful eyes of Tekashi69’s network. Over a year later, I find I am always scared of people… I cannot be in large crowds for long periods of time. I am constantly worried that when my friends are on the internet they are going to come across the video of me running for my life, escaping the foyer where the gunmen rushed us. This thought, along with me leaving behind my assistant and client, fills me with disgust, shame and embarrassment.

I am humiliated and ashamed that this was turned into a viral joke by Tekashi69 for filming off his home, while his thugs did his dirty work to me, a grandmother and my gay assistant. Everywhere I go I feel judged. I am living in fear each day as the news promotes his release I am more fearful. I had terrible nightmares for a long long time. I would wake up sweating and crying and go to children for comfort. I still get flashbacks sometimes. There are thoughts in my head that are memories of the things that I am about to die. My heart races and I will feel sweaty and then a stronger picture will pop up in my head and I become paralyzed with fear, unable to leave my home once again. With the videos still garnering views, its like I can’t escape, no matter where I am. I also fear for my assistant who lives in Brooklyn. Because I’ve had so many bad dreams, I find it hard to sleep when it’s dark. I like to keep the lights on thinking that will protect me from bad dreams. I hate scary movies and sometimes have nightmares for days. Sometimes I have unreasonable fears that prevent me from doing the normal things. I had to quit a job I was very successful at. I have had over 20 years working with all sorts of entertainers. Not once have I ever been put in a situation where myself or my team, my clients are in any kind of danger. I am appalled and disgusted by this evil person that is Tekashi69. had as a waitress because there was a guy who I thought was always staring at me. I couldn’t stop thinking, did he recognize me? Did he see my pictures somewhere? I was simply too uncomfortable to keep working there. I am extremely frightened and can no longer successfully work in the music industry and I have since discontinued taking on new clients. I lost the client who was with her in New York; after the robbery he cancelled their contract immediately. My entire career and my assistant and lifelong dreams were destroyed as a result of this horrific event. I have been struggling to get back on my feet. Financially, I was ruined, which has caused a great deal of stress. I need counseling but unable to afford it. Presently, I am on various anxiety medications and sleep aids. Sadly, I am unable to eat at times, unable to sleep, having nightmares, and has also been suffering from depression. How much is my life worth? How much was my assistant’s life worth? Did I deserve to die, hundreds of thousands of miles away from my grandchildren? I feel that Daniel Hernandez, Tekashi, is liable and should be held legally and monetarily responsible for emotional distress, damages, losses and so much more. I pray that you can find it in your heart to help this innocent grandmother and recent widow and young man find peace from this entire ordeal and get my life back. Respectfully, Aka Skyy L. Daniels"

  On October 17 co-defendant Jamel Jones was set to be sentenced, initially at 2:30 pm, then 9:45 am. Inner City Press inquired into having a live feed into the SDNY Press Room, as was the case for the sentencing of Roland Martin. But it was not done.

  At 9:45 am Jamel Jones' family members were in Judge Engelmayer's courtroom, but not Jamel Jones himself. Later he was brought in by Marshals and the proceeding began. It turned out he and his lawyer had not been given an opportunity to in writing address what the US Attorney's letter said was shown at trial, that Jim Jones spoke of "violating" 6ix9ine and Jamel Jones said "super violate."

   Inner City Press tweeted, as it did during the trial and the Roland Martin sentencing, here. Then Judge Engelmayer said, Mr Smallman tells me someone is tweeting. Who is it?

  Inner City Press immediately said, Me, adding that it had asked for a live feed into the Press Room.

  Judge Engelmayer said that if request for live feed are made they are granted. But it wasn't in this case. Inner City Press immediately shut down its phone, power off. An Assistant US Attorney came in and started using her phone, as has always been the case. She was told to turn it off.

   Now will less detailed information we report that Judge Engelmayer told Jamel Jones that he, unlike Roland Martin, had not renounced Nine Trey. That it was too late in life to use lack of a father figure as an excuse. (In fairness, Judge Englemayer later called out the father in the gallery.) Ultimately Judge Engelmayer imposed a full 135 month sentence on Jamel Jones, more than 11 years.

  While some might not like it compared, many white collar criminals in the SDNY are given light or time served sentences. This is one of the many reasons that detailed, real time reporting of these sentencing should be encouraged, not stopped and penalized. As Inner City Press left the courtroom, it was asked for its name and business card and was told that an "incident report" will be made. We'll have more on this.



  6ix9ine hopes to get "time served" for his cooperation, rather than the 47 year mandatory minimum he would otherwise face for what he pleaded guilty to. The government's total discretion under Section 5K, and judges' separate ability to ignore the prosecutors' recommendations, were brougtht to the forefront his week in the Honduras drug trafficking case in the SDNY.

 In that case, which Inner City Press is also covering, Alex Ardon admitted to killing 56 people, but still stands to get a 5K1 letter. We'll continue to cover both cases.

 Judge Engelmayer was responding to a joint move to expedite sentencing, and publish (tweet) the letter here: "Dear Judge Engelmayer: The parties respectfully write to request that a presentence investigation report be ordered and that a sentencing date be scheduled for Mr. Hernandez. Counsel for Mr. Hernandez respectfully requests that sentencing be scheduled on an expedited basis. The Government does not object to this request. In order to facilitate the request for expedited sentencing, the parties waive the 35-day notice requirement pursuant to Fed. R. Crim. P. 32(e)(2). Respectfully submitted, GEOFFREY S. BERMAN."   Along with guilty findings on racketeer, Count 1, and Counts 2, 5, 6 and 7, it issued "Not Guilty" rulings on Ellison Counts 3 and 4 and with regard to Nuke Mack and guns, Count 7. After more than an hour, got and published it:

Count 1 Racketeering - Guilty
Count 2 Kidnapping - GUILTY
Counts 3 & 4 Ellison gun - Not guilty
Count 5 (maiming) - Guilty
Count 6 narcotics - Guilty
Court 7 Mack firearm - Not Guilty

  What the verdict may mean for 6ix9ine's bid for both a 5K1 cooperator's letter and "time served" instead of the 47 year mandatory minimum he would otherwise face is not yet known.

On October 2 the jury while deliberating on a verdict asked for information including the testimony of Ellison's then girlfriend Ms. Ramirez and a laptop full of phone records. They will resume deliberating on Thursday October 3 but if they do not reach a verdict that day will return only on Monday. Meanwhile there were thirty in the courtroom and thirty in the hall.

Ellison's defense lawyer Deveraux Cannick told the jury to closely review #6ix9ine's testimony, says he was prepared for hours and hours by the government and still there are holes in his story.

 Cannick emphasizes that #6ix9ine said he only made one call, a Facetime to his daughter. Turns to Cruz claiming he's worthy of your belief. "Ladies and gentlemen, I don't buy it."  Cannick is saying sometimes the government should tear up the 5K1 letter, but doesn't. Here's Inner City Press on a cooperator who after the deal smuggled drugs into private prison and sold them. Judge Gardephe was outraged, gave 4 years

 Government objects to Cannick saying a Kristian Cruz call was in the last six weeks. Judge Engelmayer doesn't rule, tells jury that their recollection will control. Cannick going back and forth between references to #6ix9ine and Cruz

 Cannick: Cruz has no familiarity with Harv. He said, "Harv is not a thief" only in order to prime the pump and get Mel Murda to talk. But where did Mel Murda get his info from? Shotti. But #6ix9ine said "Shotti is a liar. Shotti is a fraud."

Cannick asked why the government didn't take at face value their witness #6ix9ine's view that Shotti was a liar.   Says of course Mel Murda told Cruz whatever he wanted- he needed Cruz' drugs and money. More here.
