Scam Smokehouse Blue Diamond Almonds Litigated in SDNY In Graham & BBQ Shadow

SDNY COURTHOUSE, Feb 18 –  Blue Diamond Growers has been sued for calling its almonds "Smokehouse" when they are not, in fact, produced in a smokehouse. They said, What does it matter?  

 On February 18 U.S. District Court for the Southern District of New York Judge John P. Cronan held a proceeding. Inner City Press covered it.  

A distinction was made with vanilla - a flavor, not a structure, as Judge Cronan put it - and also with barbeque potato chips. The defendants pointed out that few think that BBQ chips are in fact cooked on a barbecue. 

But what about smokehouse? Inner City Press live tweeted some of it, here:

Flavor of the law: Blue Diamond Growers has been sued for (mis?) using the term "smokehouse."  SDNY Judge Cronan says, Vanilla is a flavor, but smokehouse is a structure. Company says reaonsable consumers do not read the "smokehouse" literally. #nuts

 "Smokehouse" almond oral argument is still going. Lawyer says that barbeque potato chips are not, in fact, cooked on a barbeque. Judge Cronan: I'm trying to get to the core, or kernel, of the nut.


 SDNY Judge Gregory H. Woods recently made corporate news with his analysis of the Graham in Graham cracker. What will Judge Cronan does with the smokehouse?
