In Ozuna Case SDNY Judge Vyskocil Gives Oleaga Final Warning As Shroff Cites W2

SDNY COURTHOUSE, July  7 -- On March 24 Erick Oleago's lawyer Sabrina Shroff announced in the SDNY Magistrates Court that a case of Coronavirus had been identified in the MCC jail and 11 North locked down.

 On May 4, Shroff wrote to SDNY District Judge Mary Kay Vyskocil in rare opposition to an SDNY prosecutor proposed protective order: "Re: United States v. Ozuna 20 cr 213 (MKV) Dear Judge Vyskocil: I write on behalf of Mr. Erick Oleaga, and in opposition to the government's request that the Court enter its proposed protective order. See Docket No. 62. The order as drafted is over broad, and, given the on-going pandemic, makes meaningful review and preparation of defendant’s case difficult, if not impossible."

 On July 7, Judge Vyskocil - and Shroff and Oleaga - held a proceeding. Inner City Press live tweeted it:

AUSA Bagliebter: We are concerned... We defer to Pre-Trial Services.

Judge Vyskocil: Anything from Pre-Trial? Speak louder.

Pre-Trial: I don't believe there are any conditions that could ensure his compliance. We urge revocation of bail and remand to Marshals.

Pre-Trial: I hoped having this hearing scheduled would help defendant regain compliance. But last weekend he was out for hours.

Defense lawyer Shroff: He is working. Judge Vyskocil: He was supposed to provide verification.

Shroff: I have the W-2. It's on the books... We can't re-do his childhood. Let's try one judicial warning, and another hearing in three weeks or 30 days. He's enrolled in therapy. I've heard from another lawyer that MDC is on lock-down due to a loose gun [! picked up]

Judge Vyskocil: Ms. Shroff, I signed an order on June 4 modifying bail conditions to provide for mental health. You're telling me that has not yet been done?

Shroff: It was scheduling. Judge Vyskocil: Mr Oleaga, you are in a very serious situation here.

 Judge Vyskocil: I will give you one more chance. I will ask Pre-Trial Conference to keep me informed. I will set another status conference, I'm not going to call it a bail hearing because I hope it is not that. Final warning.

 We hope to have more on this - or not.

 The case is US v. Ozuna, et al., 20-cr-213 (Vyskocil)
