Drug Software Case in SDNY Must Await Restart of Jury Trials As Sealing Is Sought

SDNY COURTHOUSE, Feb 10 –  Medacist Solutions Group sued CareFusion Solutions about an agreement under which CareFusion was supposed to act as the “exclusive re-seller” of drug diversion analytics software developed by Medacist. 

   On February 10, U.S. District Court for the Southern District of New York Judge Jesse M. Furman held a proceeding. Inner City Press covered it.  

There was much talk about when a jury trial could be held. Judge Furman recounted that he has not been in the courthouse for a while, and that when he returns as with his colleagues there is a backlog of criminal prosecutions, many with defendants in pre-trial detention. Those must come first.  

 The parties thanked Judge Furman for the transparency - then asked how to proceed to get their filings sealed. Judge Furman said to email but be conscious of the applicable standards. We may have more on this.

The case is Medacist Solutions Group, LLC v. CareFusion Solutions, LLC, 19-cv-1309 (Furman)
