As Overtime Case Heads To Mediation Doubts About Waiving Discovery Disputes in SDNY

SDNY COURTHOUSE, Nov 24 – Nathaneal Chevalier sued Sharp Pros LCC, a building management company he worked for, under the Fair Labor Standards Act for not paying overtime.  

 On November 24 U.S. District Court for the Southern District of New York Judge Ronnie Abrams held a proceeding. Inner City Press covered it.

 The parties have scheduled a December 3 mediation, but suddenly there is an issue with sharing documents before it, on the theory that would waive arguments that could later be advanced if the mediation does not work. 

 Judge Abrams listened, then urged the parties to talk again and agree the showing the documents for purpose of mediation is not a waiver.

The case is Chevalier v. Staffpro, Inc. et al., 20-cv-7006 (Abrams)
