In Consolidated Case Google Must Produce Discovery in 30 Days Or Sanctions & Default

SDNY COURTHOUSE, Feb 7 – A number of antitrust cases against Google have been transferred to and consolidated before U.S. District Court for the Southern District of New York Judge P. Kevin Castel. On September 24, 2021 he held a conference, and Inner City Press covered it. 

 Judge Castel said, among other things, that he would first address the state case, and see if there is Federal jurisdiction.

The question of whether there is harm to competitors will not be addressed at this time.   

Counsel for Associated Newspapers has also represented Facebook, against which the same claims could and may be brought - so counsel has been asked to explain by October 1 how this is not a conflict and "why it should be permitted to attend meetings of the Plaintiffs Coordinating Committee."

On February 7, in the now consolidated case, Judge Castel in an order reminded Google of its discovery commitments and ruled that "within 30 days of this Order, Google shall produce to all plaintiffs in the above-captioned MDL all documents without limitation produced by Google or any corporate affiliate to the State of Texas from January 1, 2018 through September 24, 2021... Google is advised that failure to comply will result in sanctions pursuant to Rule 37(b), FRCP, which may include the striking of its answer and entry of judgment against it."

The September 24, 2021 case was  Associated Newspapers Ltd. et al v. Google LLC et al., 21-cv-3446 (Castel)

Now the case is In Re Google Advertising Antitrust Litigation, 21-md-3010 (Castel)
