SDNY COURTHOUSE,
Oct 18 – For US v
Bankman-Fried, after more than
a day of jury selection, late
morning on October 4 the
twelve and six alternate were
selected. Inner City Press
live tweeted the voir dire here
and more below
On October 18,
there was a dispute about
SBF's Direct Messages trashing
regulators and saying Nishad
Singh was embarrassed and
guilty. Thread
AUSA Sassoon: The
defense is objecting to some
Direct Messages between the
defendant and another user on
November 16, 2022.
SBF's lawyer:
These are prejudicial. He
thought the person was a
friend, they were off the
cuff. He meant, History is
written by the winners
SBF's lawyer: In
these messages, Mr.
Bankman-Fried says of CZ that
he was a month ago about about
no unethical s-h-i
Judge Kaplan:
I've heard this before.
SBF's lawyer: OK
now I'll says it, Unethical
shit. He goes on--
Judge Kaplan:
Slow down. I listen to 33 RPM
SBF's
lawyer: It's prejudicial, this
talk of unethical shit. Judge
Kaplan: You mean 803A? SBF's
lawyer: Yes. And 803B, musings
about the past, he uses the
word guilt but means personal
feelings of guilt, it's
prejudicial.
SBF's lawyer:
They want to show his messages
about regulators to show that
his outreach to them was all a
scam. But he was sincere,
then. He got
frustrated... AUSA
Sassoon: There are admissions
by the party proponent. That
he thought it was private is
probative
[Note: while the
messages have not been shown
during this argument, this
appears to be one of them -
meanwhile, they are taking
afternoon bread, thread will
continue below
They're back.
AUSA Sassoon: Alameda changed
its name to Clifton Bay
- and also to Goodman
Investments. GX783, what are
these? Medrano: Twitter direct
messages between Cosmo and the
defendant. AUSA Sassoon: And
this? Medrano: Silvergate due
diligence form by SBF
AUSA
Sassoon: What does this DM
say? Medrano: We bought out
Binance's stake in FTX. AUSA
Sassoon: Who posted this
tweet? Medrano: Shaq.
AUSA: Who's that?
Medrano: A former
basketball player AUSA: Is
this Shaq and SBF? Medrano:
Yes [SBF has a little football
drawing on his shirt]
AUSA
Sassoon: Do you see Mr.
Ballensweig saying, Hit me in
5?
Medrano: Yes.
AUSA Sassoon: And this message
with Frank Chapparo? Medrano:
The defendant says he's gonna
stop lobbying [And more - aim
to publish this exhibit, about
Gensler
[Now they're
showing SBF liking pro-FTX
tweets, that ask "what exactly
is CZ talking about?"] AUSA
Sassoon: And this message,
about Philip Morris and
unethical shit - what did SBF
reply? Medrano: He replied,
Heh... And all this dump shit
we woke Westerners say
AUSA
Sassoon: What did SBF DM on
Nov 16? Medrano: That they
were gone, Gary is scared and
Nishad is ashamed and guilty.
AUSA Sassoon: And when asked
about lobbying for regulation?
Medrano: SBF replied, F*ck
regulators
AUSA Sassoon:
Then SBF wrote, Didn't mean
for this to be all on the
record?
Medrano: Yes.
AUSA Sassoon:
What is Vox? Medrano: I'm not
sure.
AUSA Sassoon: No
further questions.
