April 3 – Swinerton Builders
and the Indian Harbor
Insurance Company have not one
but two lawsuits going: one in
California, and one in the
U.S. District Court for the
Southern District of New
York. On
April 3 SDNY District Judge
Lorna G. Schofield held a
conference. Inner City Press
covered it.
She began by
saying it is her preference or
practice to keep things
moving, not to stay discovery.
After asking
about the case in California,
and choice of law, she said it
would be interesting to see
what happens in the other
case. She said she will be
issuing a scheduling
order.
There is an
application to unseal and more
pending in another case on her
docket, criminal SLAPPing into
civil, on which action is
awaited.
This case
is Indian Harbor Insurance
Company v. Swinerton Builders,
24-cv-49 (Schofield)
