SDNY
COURTHOUSE,
April 5 – Zesty Paws LLC sued
Nutramax Laboratories Inc. in
late 2023 seeking to "put an
end to baseless accusations
and threats of litigation" by
Nutramax about its claim to be
the USA's #1 Brand of Pet
Supplements."
But U.S.
District Court for the
Southern District of New York
Judge Lorna G. Schofield, to
whom the case was assigned,
granted a preliminary
injunction against Zesty Paws
making the #1 claim, at least
in some Costco
stores.
On April 5 Judge
Schofield held a proceeding to
set the ground rules for a
preliminary injunction hearing
to be held on April 16. Inner
City Press covered it.
She told the
parties that they'll get 15
minutes for opening
statements, and two hours
total, "on your
feet." It
seems fast and to the point,
while an anti-SLAPP request to
unseal, filed a week before in
an unrelated criminal case,
remains pending.
This case
is Zesty Paws LLC v.
Nutramax Laboratories, Inc. et
al., 23-cv-10849 (Schofield)
