SDNY
COURTHOUSE,
May 6 – A man given a life
sentence in 2010 for killing a
marijuana dealer in 2003 is up
for resentencing after Supreme
Court decisions that attempted
Hobbs Act robbery is not a
crime of violence.
The U.S.
District Court for the
Southern District of New York
prosecutors, while noting a
defense request to more time,
on Saturday March 30 filed a
memo asking that any
re-sentencing be for 80 years
- constructively,
life.
They
describe attempted robbery of
dealers on Burke Avenue in The
Bronx, which Inner City Press
covers closely, as it does
SDNY, then in Elmont NY
resulting in the death by
murder of Stephanie Laing, and
at 4385 Wickham Avenue in The
Bronx resulting in the murder
of Gary
Grey.
On April 1, the
April 2 re-sentencing was
pushed back to May 6 at 10 am.
And on the day,
his life sentence was reduced
to thirty years: "Minute Entry
for proceedings held before
Judge Alvin K. Hellerstein:
Re-Sentencing held on 5/6/2024
for Roderick Gunn (4) Count
1-3,8. Deft. pres. w/atty.
Samuel Jacobson; AUSAs, Jane
Chong and Matthew King pres.;
Court reporter Rebecca Forman
pres.; Deft. is sentenced to
360 months custody, 180 months
on each of counts 1 and 3 to
run consecutive and 60 months
on count 8 to run
consecutively; sentencing to
run consecutive to sentencing
in case 03 Cr. 1277;
Supervised Release - 4 years
of supervision on count 8 and
3 years on count 1 and 3 to
run concurrent; See judgment
for Special Conditions; Counts
6 and 7 are vacated. Deft.
cont'd. remanded."
The case is US v.
