Epstein MCC Bunking Before Sentencing May 21
Moves For New Trial

SDNY COURTHOUSE,
March 30 – To withhold
documents about the death of
Jeffrey Epstein in the
Metropolitan Correctional
Center in lower Manhattan, the
U.S. Department of Justice
cited the then-pending trials
of Corrections Officer Tova
Noel and the still-pending
death penalty trial Michael
Thomas and former Briarcliff
Manor Officer Nicholas
Tartaglione.
But how much of
it was a cover-up?

On August
26, 2022 DOJ filed a lengthy,
partially redacted opposition
to Tartaglione's motions to
strke the death penalty. It
wrote, "the Death Penalty
Notices alleges that Urbano
Santiago, Miguel Luna and
Hector Gutierrez were
"kidnapped and killed to
prevent them from providing
information to law enforcement
regarding the kidnapping and
murder of Martin Luna."
DOJ's
August 26 brief argues that
"The Death Penalty is
Constitutional" - then 10
pages of redacted responses on
"as-applied Constitutional
challenges." Inner City Press
believed and believes that it
should all be unsealed...
On April 6, 2023,
Tartaglione was convicted of
the quadruple murder, all
counts, and SDNY said, "Today,
a jury has found Tartaglione
guilty of these heinous acts,
sending a message that no one
is above the law. We
commend the career prosecutors
and investigators for their
relentless pursuit of justice
in this case over the past
seven years, and for ensuring
that Nicholas Tartaglione
faces a lifetime in federal
prison for his unconscionable
murder of four men."
Then docketed:
"LETTER by USA as to Joseph
Biggs addressed to Judge
Kenneth M. Karas from AUSAs
Maurene Comey, Jason Swergold,
and Jacob Fiddelman dated
April 6, 2023 re: Sentencing
and Unsealing Document filed
by USA. (Comey, Maurene)."
On June 23, 2023,
Tartaglione's lawyer wrote to
Judge Karas about a
non-docketed AUSA letter
"regarding a telephone at the
MDC," to say that the phone
was not Tartaglione's and that
he wants out of the MDC
asap. He was "place in
the SHU (evidently the person
who did plug in the telephone
was a reputed gang member)."
The request is for the video
"of the incident which
exonerates Mr. Tartaglione."
Judge Karas has ruled that the
US' response is due by June
27.
On June 27, the
US Attorney's Office replied
in opposition, saying there is
no basis for their or the
Court's involvement in this
"administrative matter." It
then characterizes the video -
which it says the defendant
should contest through the BOP
disciplinary process.
On October 13,
Tartaglione's sentencing was
pushed back: "ENDORSED LETTER
as to Nicholas Tartaglione
addressed to Judge Kenneth M.
Karas from Attorney Inga
Parsons dated October 12, 2023
re: We therefore respectfully
request that Mr. Tartaglione's
post-trial motion date be
extended to October 31, 2023,
with the Government's response
extended to November 30, 2023.
We also request that the Court
adjourn the current sentencing
date of October 31, 2023,
until after the resolution of
the post-trial motions.
ENDORSEMENT: All requests are
granted. Sentence is adjourned
to 2/21/24, at 2:00. So
Ordered. (Signed by Judge

10/12/2023)."
Sentencing was
moved back to May 21, 2024 at
2 pm. On March 29,
Tartaglione's Federal
Defenders argued for a new
trial based on ineffective
assistance of counsel and
nitty gritty facts such as
"when Young is interviewing
Marcos, Young says, 'this
video is from next to the
cleaners' which would have
been Bagel Girls not Sunoco or
the Salon."
