SDNY COURTHOUSE,
May 11 – A
man charged in
a five kilos
of cocaine
narcotics
conspiracy has
a lawyer who
has been
indicted and
who, if
convicted,
would be
disbarred.
A
move is afoot
to assign him
a second
lawyer.
On
May 11, 2023,
U.S. District
Court for the
Southern
District of
New York Judge
P. Kevin
Castel held a
proceeding
involving the
indicted
lawyer,
Telesforo Del
Valle. Inner
City Press,
which is
covering both
cases, was
there.
In jury box
with US
Marshals were
Del Valle's
client,
Roberto Juan
Nieves Perez
and three
co-defendants.
Along with
setting a next
conference for
September 7 at
noon, Judge
Castel asked
Del Valle for
the status of
his
case.
It
has been
indicted and
assigned to a
Northern
District
judge, sitting
in the SDNY.
Trial has been
set for
November
30.
Judge Castel
instructed Del
Valle to meet
with his
client and
fill out a
financial
affidavit,
with an eye to
appointed a
CJA lawyer as
co-counsel.
But what if
the client is
not eligible?
Could he be
ordered to pay
for a second
lawyer? Or
made to go to
trial pro se
if Del Valle
is convicted
at trial, or
pleads guilty
to a felony?
