SDNY COURTHOUSE,
June 20 – Elvis Guerrero and
others were indicted on
charges of gun trafficking
from Maine to the Dominican
Republic.
On June
12, 2023, U.S. District Court
of for the Southern District
Magistrate Judge Ona T. Wang
took Guerrero's guilty plea.
Inner City Press was there,
the only media in the SDNY Mag
Court.
The plea
deal is for a 78 to 96 month
sentencing guideline. As
described by the AUSA, the
guns were to go through Red
Hook - in Brooklyn, that is,
the EDNY -- but through waters
over which the SDNY says it
has jurisdiction.
Guerrero's
Federal Defender consented to
venue; despite the AUSA's
suggested questions, he did
not name his
co-conspirator(s).
On December
5, the US Attorney's Office
wrote in asking, for Guerrero,
for 90 months, the top of the
guidelines.
On December 12,
Judge Castel sentenced
Guerrero to 68 months, and
recommended near Boston.
Jump cut to June
20, 2024, when co-defendant
Henry Feliz Arias had his
final pre-trial conference.
Communications by Guerrero to
Arias are sought to be
excluded, as is a seeming
death threat from Arias to
"Employee-1," after Arias'
mother was arrested in the
Dominican Republic. Judge
Castel said he will reserve
judgment until trial, which
begins July 8. Watch this
site.
The case is
US v. Guerrero, et al.,
22-cr-629 (Castel / Wang)
