For Kicking Cuffed Prisoner in Chest Dustin Genco Took Plea Now Delays Sentencing

SDNY COURTHOUSE, Nov 28 – A misdemeanor criminal plea to Deprivation of Rights under Color of Law was entered by Dustin Genco on August 2, 2023 before U.S. District Court for the Southern District of New York Magistrate Judge James L. Cott.

AUSA: The plea agreement is unique. Judge: It says defendant will not seek law enforcement employment. Do you agree? Answer: Yes.

Sentencing set for 10 am on December 6.

But on November 27 Genco's counsel asked to delay it, with the prosecutors' consent, to January 24, 2024 - and it was granted by Magistrate Judge Cott on November 28.

The case is US v. Genco, 23-cr-391 (Subramanian / Cott)
