COURTHOUSE,
July 24 – Carl Hall was
sentenced to life in prison
for conspiracy to commit
murder and other racketeering
offenses included torture and
slashing a bodega owner. Later
he was resentenced to 40
years. Now, dying of cancer,
he is seeking compassionate
release.
On
July 11 U.S. District Court
for the Southern District of
New York Judge Jed S. Rakoff
held a hearing. Inner City
Press was there, the only
media in the courtroom. Also
in the courtroom was Hall's
cousin / sister - she said
they were raised like sister
and brother and have
reconnected in the last five
years.
The
prosecutor referred to
torture, and to disciplinary
infractions. Inner City Press
has checked the docket and
there are many, including
throwing feces at guards --
something Inner City Press in
another case witnessed when
visiting a man then on death
row in Huntsville, Texas,
Robert West, since executed --
and indecent exposure.
His cousin
/ sister said he has had a
hard life, that his father
died in prison and he has
"slept in bathrooms for the
past 25 years" but is
changing.
Judge
Rakoff noted the prognosis
that Hall has 18 months to
live, and promised to issue a
ruling on eligibility for
compassionate released by the
end of next week: July 25.
Docketed on July
15, another letter / email
from Hall: "I would like the
court to know that the BOP /
FMC-Buter closed down the
Hospice care unit on the 5th
floor death house... Now
inmates are sent to the 5th
floor to die with no family
and very little nursing staff
to take care of them."
On July 24, Judge
Rakoff ruled: "OPINION &
ORDER as to Carl Hall: For the
foregoing reasons, the Court
is inclined to grant Hall's
motion for a sentence
reduction. But his release
cannot properly occur until
appropriate conditions for his
release have been arranged...
only one of these plans is
satisfactory to the Court.
Under this plan, Hall's family
would rent a one-bedroom,
ground-floor apartment for him
in Hackensack, New Jersey,
near the Hackensack University
Medical Center. Hall's family
would arrange for a home
health aide to stay with him
during the overnight hours,
and family members and friends
would attend to his needs
during the day. The Court
hereby grants Hall's release
conditioned on, and only to
take effect when, Probation
Officer Greene certifies to
the Court and to the BOP that
he is satisfied that the
release plan described above
is finally ready to take
effect. SO ORDERED. (Signed by
