June 6 – Cuba
Gooding, Jr.
faces a civil
trial for
allegedly
violating
NYC's Victims
of
Gender-Motivated
Violence
Protection Law
in Soho's
Mercer Hotel.
The
female
plaintiff had
been
anonymous, as
"Doe" - but at
the June 1
final
pre-trial
conference
Gooding's
lawyer said
her real name
not once but
twice, along
with
information
about her
bankruptcy
filing that
otherwise
identifies
her. See
below.
On
June 6, the
day of jury
selection,
this: Action
resolved
(settled and
withdrawn) -
There will be
no trial in
the above
matter. And in
the docket,
"*TRIAL OFF*:
The jury trial
scheduled to
go forward
today is off
the calendar.
Reason for
cancellation
(on consent):
the parties
have resolved
the matter."
After
oral argument,
Gooding's
council filed
with the court
citing Rapp v.
Fowler (Kevin
Spacey) as
"observing
that stigma
and
significant
reputational
damage to
defendants
accused of
sexual assault
increase when
plaintiffs
proceed
against them
anonymously) -
and so,
seeking to
"unmask."
Later
on June 2,
Judge Crotty
ordered
it:
MOTION
Maintain
Pseudonym
Status at
Trial . filed
by Jane Doe.
Plaintiff's
motion to
maintain a
pseudonym is
DENIED.
Plaintiff
shall file an
amendedcomplaint
containing her
name no later
12:00 PM on
Monday, June
5, 2023." It
seems the name
is here
