SDNY COURTHOUSE,
Jan 25 – In a multi-defendant
South Bronx narcotics
conspiracy case, one defendant
now intends to plead guilty on
October 3, 2023 while the
others have until November 16
to decide or face having their
case transferred.
The
remaining defendants were
placed in the jury box on
September 21, 2023 before U.S.
District Court for the
Southern District of New York
Judge Naomi Reice Buchwald.

Judge
Buchwald reminded that she
said she would transfer the
cases to another judge for
trial - and added that
defendant Frankie Capellan is
now set to plead guilty. (It's
set for October
3).
The AUSA said
that the other defense counsel
want six to eight weeks to
decide, adding that if the
field is narrowed perhaps the
case will not be
transferred.
On December 6,
counsel for co-defendant Jose
Figueroa wrote in to say he
plans to plead and to excuse
him from the next status
conference.
On January 4,
2024 there was a pre-trial
conference, now with three
defendants. One had just filed
a motion to dismiss alleging
the use of fabricated evidence
with the grand jury, springing
from overdose deal in the
holding cell of the 40th
Precinct in The Bronx.
Judge Buchwald
said, assuming arguendo the
motion is denied, trial should
be in May. The defense
countered with early July,
whereupon the AUSA said late
July. Judge Buchwald said she
will decide.
On January 25 for
co-defendant Frankie Capellan
who pled, the US asked for 262
months.
