May 31 – Rudy
Santana was up
for sentence
on a violation
of supervised
release on May
31 before U.S.
District Court
for the
Southern
District of
New York Judge
George B.
Daniels. Inner
City Press was
there.
Santana's
lawyer said
his client has
gained 80
pounds in the
past year in
custody and is
healthier, on
methadone. The
prosecutors, a
long-time
AUSA, read
from Santana's
2012 letter to
the Court,
promising them
to turn things
around.
Santana's new
lawyer - who
said 2012 was
about
violence, this
about drugs -
asked for
twelve months,
ten of them
already
served. Judge
Daniels
imposed 18
months, and
three years
more of
supervised
release.
The
prosecutor
asked for six
months of
in-patient
drug treatment
once Santana
is released.
Santana
shook his head
No, and his
lawyer
objected.
Judge Daniels
said if
Santana tests
positive for
drugs in the
first six
months he's
out, he will
entertain an
application by
probation for
in-patient
treatment, or
re-incarceration.
It's
up to you, Mr.
Santana, Judge
Daniels said.
