SDNY Judge Rakoff Had Set Robbery Trial Then Guilty Plea so Defendant Asks 8 Months

SDNY COURTHOUSE, March 19 – In a multi-defendant robbery conspiracy case, on July 20 U.S. District Court for the Southern District of New York Judge Jed S. Rakoff held a scheduling proceeding.

Counsel including Lisa Scolari asked that the trial be moved back from November or December.

Judge Rakoff, who earlier in the day had held an in-person proceeding in this courtroom that Inner City Press reported on, said he would only push the trial back to January 19, pending the "Assignment Committee."

Another of the lawyers mentioned another trial schedule for that time. Judge Rakoff noted the 97% of Federal criminal cases settle.

And now, on May 11, this: "Minute Entry for proceedings held before Judge Jed S. Rakoff: Sentencing held on 5/11/2021 for Kyshawn Robinson (4) Count 2. On May 11, 2021 a telephonic sentencing was held before Judge Rakoff. Present were court reporter Sam Mauro, the defendant and his counsel, Xavier Donaldson, AUSA Kevin Mead for the government. SENTENCE on Count 2 42 months jail, remanded, 3 years SR, $100 assess, $2800 restitution, joint and several. The governments motion to dismiss counts 1 and 3 is granted."

Jump cut to March 18, 2024, when for violations of supervised release by Kyshawn Robinson the US Attorney's Office asked for 24 months, in a March 25 sentencing. They reference a burglary and shooting in Schenectady NY on October 24, 2023.

On March 19, Kyshawn Robinson's lawyer wrote it asking for eight months, when the sentencing happens on March 25.

This case is US v. Smith et al., 20-cr-153 (Rakoff)
