German Man Charged With Travel to NY with Husband to Have Sex with Minor Gets Delay

SDNY COURTHOUSE, Dec 1  – German national Thomas Alexander Brandenstein was arrested for enticing a minor into sex.

He was presented on October 2, 2023 before U.S. District Court for the Southern District of New York Magistrate Judge Stuart D. Aaron. Inner City Press was there, the only media in the SDNY Mag Court.  

The Federal Defender argued that the three NYS statutes cited were "class E" felonies that required the use of force or compulsion, not just "emotional compulsion." She argued that sex with a 15 year old in not illegal in Germany. 

 The prosecutor noted the Brandstein and his husband traveled to New York specifically to have sex in a hotel with this 15 year old, and that he wanted to bailed out to a hotel. She also noted that law enforcement now has the defendant's phone and may charge "production."

  Judge Aaron took a break with pre-trial services, then returned and ordered detention. The husband / co-defendant remains at large. 

On December 1, the prosecutors sought and got delay, saying they have "discussed a pretrial resolution of this case with defense counsel." So, "ORDER TO CONTINUE IN THE INTEREST OF JUSTICE as to Thomas Alexander Brandenstein re: [8] Order to Continue - Interest of Justice. Time excluded from 12/1/23 until 1/2/24. (Signed by Magistrate Judge Sarah L. Cave on 12/1/23)."

The case is US v. Brandenstein, 23-mj-6612 (Aaron)
