SDNY COURTHOUSE,
Nov 21 – A defendant charged
with the armed robbery of a
smoke shop in Manhattan's West
Village on Halloween night was
ordered released on bond on
November 21 in the U.S.
District Court for the
Southern District of New York
Magistrates Court. Inner City
Press was there, the only
media in the SDNY Mag Court.
The
defendant, it emerged, had
previously done odd jobs in
the smoke shop. The robber
fired a bullet at a customer
trying to flee the store.
The
Assistant US Attorney said
that the store clerk had
identified the shooter that
night, but only by first name.
Only a week later was the
clerk shown a photo
array.
Magistrate
Judge Barbara C. Moses said
perhaps the evidence was not
so strong. She noted the
impending Thanksgiving holiday
and said he could be released
on $25,000 bond with two
co-signer, but that they would
have to sign before he is
released.
The US
Attorney's Office did not say
that it would appeal to the
Part 1 Judge.
