Bronx Man Who Won Slip and Fall Case Fled Police With Gun Got Bail Now Indicted

SDNY COURTHOUSE, May 7 – A defendant who fled police in a car in The Bronx and was captured with a gun was arguing to be released on bond on May 6 in the U.S. District Court for the Southern District of New York. Inner City Press was there - thread:

OK- now back in SDNY Magistrates court, gun case against a felon who won $1.3 million in a slip and fall lawsuit and says he was then targeted. Defense says he never fired it. Judge: What about fleeing?

Defendant was arrested in January and released by NYS with no bail or conditions, charged with intent to sell. Defense says he was self medicating. Federal Defender: In one of his arrests this year, my client was beaten by the police.

Judge: That's a serious charge. Do you have any evidence? FD: I don't. But getting medical treatment after arrest is suggestive. Judge: He went to doctor for other reasons 

Federal Defender: He could continue living with his uncle. But the conditions in the MDC, and lack of medical care, must be considered.

 Federal Defender quotes Judge Dearcy Hall: "The MDC is going to have to understand that the judges of this court are no longer going to tolerate the mismanagement of the medical care of the defendants that are in their charge."  

AUSA: He has 2 drug convictions... 77 glass envelopes of heroin & 36 Perc's - he may not have brandished but he'd had three firearms. I haven't seen his medical records. But Feb, March and April - 3 arrests since our incident. Judge: What's wrong with conditions? 

AUSA: He was arrested in the Bronx and said he did not have since Pennsylvania license on him. Today he was transferred in from Rikers - Federal Defender: He was given bail but not released due to Federal hold. He posted $55,000 cash bail in January

Judge: I believe that there are conditions for release. The conduct is serious, possession of 2 guns. But in NYS court he has been released time and again.  Let me address the defendant: You are in Federal court. This is not Kansas anymore

Defendant: Yes sir.  Judge: I order you may be released on $100,000 personal recognizance bond co-signed by 2 financially responsible people, drug testing, mental health evaluation, home incarceration with GPS monitoring - how much does it cost? No guns.

On May 30, Lopez's case was indicted and wheeled out to District Judge J. Paul Oetken. It lists a Taurus .45, a 9mm Luger, and a Glock magazine.

 The case is US v. Lopez, 24-cr-350 (Oetken)
