After US Indicted Homeless Man for $80 Armed Robbery He Got 2 Years Cooperator Time Served

SDNY COURTHOUSE, April 8 - In the U.S. District Court for the Southern District of New York on January 10, 2023 a detention or bond proceeding was held by Magistrate Judge Robert W. Lehrburger on a man arrested at 6 am that day for an armed robbery in November 2020 in a three defendant case in which one defendant got probation, the other said he would plead guilty.

The US Attorney's Office asked for detention.

The robbery was for $80, the AUSA said.

The defendant, Norman Washington, is living in a homeless shelter. Inquiry was made into how GPS could work there, or stand-alone monitoring. The latter was arrived at, and a $25,000 bond to be signed by one financial responsible person within two weeks. The District Judge Paul G. Gardephe had yet to set the arraignment.

Jump cut to September 8, 2023: Judge Gardephe had scheduled a bond hearing, and Inner City Press attended. Defendant's cousin Tajh Washington was brought in, by US Marshals, to testify. He has a cooperation agreement. He said Norman planned the bodega robbery, that it was Norman's gun.

 The AUSA elicited that Tajh heard "through the grapevine and from family" that Norman was using drugs while on pre-trial release. Judge Gardephe agreed it was hearsay. The AUSA began to argue to the contrary but Judge Gardephe said he knew the standard, but this was too far. The AUSA moved on. Successfully:

The Marshals moved in...

On October 6, the sentencing of cooperator Tajh Washington was set for December 21, 2023 - then adjourned (for then) to February 14, 2024.

On February 9, Norman Washington (on whom the US asked for 46 months) got 24 months imprisonment.

The cooperator Tajh Washington was finally sentenced on April 5, 2024 - and got a time served sentence.

The case is US v. Washington, 22-cr-45 (Gardephe / Lehrburger)
