SDNY COURTHOUSE,
June 24 – Joshua Golston is
charged with using a gun to
deal drugs, while a
felon.
On June 8, U.S.
District Court for the
Southern District of New York
Magistrate Judge Sarah Netburn
held a jail or bail hearing on
Golston. Inner City Press was
there, the only media in the
SDNY Mag Court.
The prosecutor
emphasized that Golston ended
11 years in jail in August
2022 - then got a gun to deal
drugs, less than a year
later.
Golston's
Federal Defender said he was
making $80 a day at CEO. The
prosecutor described a Velcro
holster.
Judge
Netburn ordered Golston
detained pending trial.
Jump cut to
February 13, 2024 when in
advance of his February 27
trial Golston's counsel wrote
in that he "consents that the
undercover officers testify
under mutually agreed-upon
pseudonyms. We do not oppose
the measures requested to
permit Mr. Golston's family to
remain in the courtroom during
the undercover officers'
testimony without the general
public - so long as the jury
is not informed of this
precaution." This assumes that
few from the public or press
will be there... Deputy AG
ruling under 28 CFR 50.9 was
awaited, when the US filed...
On February 21,
Golston's lawyer wrote in
asking that two subpoenas be
signed, for Police Officers
Rafael Morales and Walter
Mikowsky, the latter of whom
testified to the grand jury on
July 19, 2023.
On February 22,
the US said Morales will be
available but that Mikowsky
testified only as a Task Force
Officer - and the Golston's
lawyers have not complied with
Touhy v. Ragen, 340 US 462
(1951) and DOJ's Touhy
regulations.
On March 1,
Golston was convicted.
On June 24, the
US Attorney's Office asked for
123 months with sentencing set
for July 1.
The case is now
US v. Golston, 23-cr-362
(Torres)
