Man On
Supervised Release Mistook Fentanyl for
Heroin Now US Wants Two Months Prison

SDNY COURTHOUSE,
April 13 – Tyvann Barnett was
up on a violation of
supervised release after being
sentenced to 24 months on drug
charges in 2019.
On
June 25, U.S. District
Court for the Southern
District of New York Judge
Paul A. Engelmayer held a
proceeding. Inner City Press
called in to cover it.
Judge
Engelmayer asked Barnett why
he hadn't known up for drug
treatment. The reply involved
the lack of a car / ride, and
the need to ask the
step-father for help.
But Judge
Engelmayer was not impressed
and said a violation hearing
should be held in two weeks.
Jump cut to
January 28, 2024 when
co-defendant Louis Brown was
coming up for sentencing on a
VOSR involving fentanyl which
he'd thought was heroin. He
pays $129 a month for his
subsidized studio apartment in
The Bronx, which he would lose
if he is sent to prison. He
asked for no prison, while
Probation wanted six months.
Judge Engelmayer
on February 1 gave a time
serviced sentence. On March
26, 2024, the defendant made
another admission; the US
Attorney's Office on April 12
asked for two months on April
16.
