After Defendant Got Return of $10000 Retainer  For Mompoint Now Foucault Gets Time Served

SDNY COURTHOUSE, April 9 – Kareem Shepherd was charged with access device fraud in a scheme involving a website called LuxurySnob. He retained a Court Street lawyer and paid $10,000.

  Then they had a disagreement.    A lawyer who had worked on his discovery left, but the Court Street lawyer didn't want to return the $10,000 retainer after Shepherd was appointed a Criminal Justice Act lawyer.

  On August 16, 2023 U.S. District Court for the Southern District of New York Judge Paul G. Gardephe convened a hearing about the $10,000 retainer. Inner City Press was there, the only media in the courtroom. 

 Just before Judge Gardephe took the bench, the dispute between detained inmate and former lawyer was resolved.

The lawyer recounted offering a $1000 refund then a $3000 refund, both of which he said were rejected. While Shepherd confirmed it was subsequently resolved, the terms weren't put on the record.

On August 31, new counsel for co-defendant Rashaan Richards wrote it asking for more time "to determine if there are any 'real defenses' for my client or whether he should accept a plea offer."

In December for co-defendant Johnathan Persaud the US asked for 12 to 18 months, noting on December 7 that he had stolen 28 credit cards from his mail route.

On December 15, Persaud got three years of probation.

On January 23, 2024, the US Attorney's Office asked for Shepherd to get "no loss than 84 months."

On January 31 the US Attorney's Office for co-defendant Louis Jeune Verly asked for the 24 month mandatory sentences for aggravated ID theft.

On February 7, Jeane Verly got the two year minimum - then Kareem Shepherd got seven years..

On February 12, Conrad Heron got three years.

On February 15, co-defendant Rashaan Richards asked for 48 months or four years.

On February 23, the US Attorney's Office by contrasts asked for a minimum of 87 months on Richards.

On March 7 Richards got six years, or 72 months.

On March 1 for Fabiola Mompoint the US Attorney's Office asked for at least 24 months.

On March 8, with Judge Gardephe noting designer clothes and the theft of credit cards from the mail but also mitigation, Mompoint got a one year sentence.

On March 25, co-defendant Nathanael Foucault who worked at USPS in Astoria, Queens asked for a sentence of time served.

And and April 9, he got it. The prosecutors put out a press release, FINAL DEFENDANT SENTENCED IN CONNECTION WITH $1.3 MILLION FRAUD SCHEME INVOLVING U.S. POSTAL EMPLOYEES

The case is US v. Shepherd, et al., 22-cr-514 (Gardephe)
