Brooklyn Literary Agent Weronika Janczuk Threatens Press now Gets Time Served US Seals

SDNY Exclusive, Jan 29 – Brooklyn based literary agent Weronika Janczuk was arrested on January 11, 2022 for cyber-stalking.

On July 21 the US Attorney's Office agreed to defer prosecuting her.

In September, after the DPA, Janczuk emailed a series of threats to Inner City Press, as well as demands for censorship: "Please pull all content: here  Weronika Janczuk The content sent herein is legal in nature and intent, and is protected from publication by e-channel'd privacy & security laws, IP protections, and positively-declared NDA statutes."

On October 22 and then December 22, 2023 a series of one month Orders to Continue in the Interest of Justice.

On January 5, 2024, Janczuk appeared without any advance notice in the SDNY Magistrates Court. Inner City Press was there. She pled not guilty to an information, after waiving indictment. The AUSA asked for a control date of January 29, saying his Office has extended a plea offer. The Federal Defender, who Jancsuk previously tried to fire, whispered with her. Do victims rights (to be notified) statutes apply here?

On January 9, Janczuk's Federal Defender wrote in asking for a change of plea and sentencing date in 21 days, and stating that the US Attorney's Office has agreed to ask for no jail time. The letter has a three line redaction, apparently about the US Attorney's Office agreement.

On January 16, Judge Schofield scheduled it: "as to Weronika Janczuk, Application Granted. The parties shall appear for a change of plea and sentencing hearing on January 29, 2024, at 11:00 a.m. Defendant's sentencing submission shall be filed on January 17, 2024. The Government's submission shall be filed on January 23, 2024."

  But the Government - the US Attorney's Office - did not file its letter in the docket, but rather presented it on January 29 to Judge Schofield, asking that it be sealed. Inner City Press has filed an application to unseal it. Time served given after quite an allocuation. Thread:

AUSA Robinson: No

 Judge: Are you satisfied with your Federal Defender? Literary agent: Let me be honest, I had concerns I could not get an academic phychitrist, I have no paper work to approve any request was made... I am not trying to be a pretentious client.

 Judge: Anyone coerce you into pleading? Literary agent: Film school... School of the arts.. The coffee shop that sells coffee... I did systemically request they call a detective... I may have been used by some in NY... Doppelgangers... The murder of George Floyd

Judge: All I need to know is if you were forced to plead guilty? Literary agent: Sexual abuse... transacted at the penetentiary... If someone had listened I would not have spent two years sitting alone. Judge: Did you sign this plea agreement?

 Judge: It is hard to take all this in. Tell me what you did. Literary agent: in 2022, my call concerned Dunkin Donuts size of coffee cups, not Duncan Slaughter's (sp?) reproductive organs...Catholic icons...Foxy.. I left 2 voice mails for a human person

 Judge: Is the Government satisfied with this allocution? AUSA: The victim had a restraining order. Judge: Did anyone force you to make the calls? Literary agent: Communications... Judge: Were. You. Forced? Literary agent: I volunteered.

 Judge: I accept your guilty plea. I'm going to turn to sentencing. You are waiving a pre-sentencing report. AUSA: There was a Deferred Prosecution Agreement, that was violated. There is a victim impact statement from Friday. Judge: I haven't seen it

 AUSA: We want to file it under seal. Judge: Granted. [Uh, it's a judicial document, presumptively public. The whole thing sealed?

AUSA: We recommend time served. Judge: Has there been any medical treatment? AUSA: She not been taking her medication.AUSA Ross: We prefer time served in case of a violation of supervised. Federal Defender: She will be getting out this week, using the 85%, regardless. Judge: Why not sooner? AUSA: She violated the Deferred Prosecution Agreement

Judge: Why are we not talking about inpatient mental health treatment? Federal Defender: She is high functioning Judge: She was traveling to make threats Federal Defender: It was all talk. She was just in the lobby

 Judge: What if I order inpatient treatment? Federal Defender: I suspect Probation would say there's no place for her. Judge: There's no one from Probation here.

 Judge: What about outpatient? Federal Defender: That's what Probation does Judge: But there's nothing set up? Federal Defender: There us not. Literary agent: Twin Cities... Catholic Church.. St Paul's... sexualized, these conversations referred to physical objects

 Literary agent: I don't think I need psychiatric care. Judge: What about the victim? Literary agent: Mr. Slaughter's circles... There were females involved... NY... religious abuse. A city that has a Jewish history... Pieces of paper

Judge: I am required to impose a sentence that will protect the public... Tools are lacking... You removed your ankle bracelet... You entered a Deferred Prosecution Agreement... You violated all conditions... Both parties want you released today

Judge: I sentence you to time served and 1 year of supervised release...
